UDA Amendment

At the car insurance news room we have been reviewing a recent appeal case that has re-written an agreement. The Uninsured Drivers Agreement (UDA) 1999 has effectively been amended by default after a recent ruling on the court case Phillips v Motor Insurance Bureau (MIB). The court case which was an appeal by the MIB on a previous ruling found in favour of Lousie Phillips who�s husband was killed in road traffic accident in 2002.

Mr Phillips had been a passenger in a vehicle driven by an uninsured driver whom he knew was not covered by proper car insurance. By this reason alone the Motor Insurance Bureau MIB refused to submit compensation according the written word of the Uninsured Drivers Agreement. Following the court of appeals ruling there is now a new interpretation of the UDA which will open the doors for many like cases that will allow relatives to be compensated.

The MIB do not feel the amendment to the Uninsured Drivers Agreement will impact them significantly but that will have to wait time to confirm this.
